ABA Free Legal Answers hits major milestone of 250K questions

After George “Buck” Lewis became president of the Tennessee Bar Association in 2008, he attended a series of court-sponsored public meetings that addressed unmet civil legal needs around the state.

During one of those meetings, he was struck by an idea.

“It just occurred to me that there were lawyers sitting in this hearing on BlackBerrys—they were BlackBerrys back then—emailing their clients,” says Lewis, a shareholder in Baker, Donelson, Bearman, Caldwell & Berkowitz’s Memphis, Tennessee, office. “Could we provide legal services that way for pro bono clients?”

Lewis talked with his firm’s IT staff, who developed code for an online program that could facilitate conversations between pro bono lawyers and people who needed legal assistance. He helped launch the platform—which served as a virtual legal advice clinic and became known as Free Legal Answers—in 2011. He also shared the code with colleagues in Indiana, South Carolina and a few other states.

Lewis later joined the ABA Standing Committee on Pro Bono and Public Service and after discussing Free Legal Answers with other members, he began leading the association’s effort to make the program available nationwide.

Since ABA Free Legal Answers launched in 2016, more than 11,000 pro bono attorneys have registered to respond to civil legal questions from income-eligible users in 41 jurisdictions. The program is run in partnership with a number of state and local bar associations, as well as legal services organizations throughout the United States. The platform also now accepts questions on federal immigration and veterans’ issues.

“I heard for years that some jurisdictions didn’t have any kind of traditional walk-in, limited scope clinic and the ones that did were often out of reach for clients because of limitations of time and space,” Lewis says. “As emails and the internet became more ubiquitous and available at libraries and churches, and more available to the public, it was just a simple idea, but it came along at the right time.”

ABA Free Legal Answers hits quarter of a million questions

ABA Free Legal Answers reached a major milestone in November, surpassing a total of 250,000 questions. Civil legal questions receive a response from a volunteer attorney or a list of relevant resources. Volunteer attorneys respond to most questions, but they cannot answer criminal law queries.

“For more than six years, ABA Free Legal Answers has provided a critical resource for civil legal matters for those who cannot afford an attorney and have nowhere else to turn,” ABA President Deborah Enix-Ross said in a news release. “We have now topped the quarter-million mark in questions and have more than 11,000 volunteer lawyers nationwide generously providing services.

“We are so grateful for those attorneys who have participated. But the need is still great. We urge other attorneys to step up and assist as well.”

Henry Su, the chair of the Standing Committee on Pro Bono and Public Service, began volunteering with the platform in 2019. He had handled several pro bono cases but never had heard of the virtual legal advice clinic until he joined the committee.

Su suspects the same could be true for many ABA members, who may only think of pro bono work as finding someone a lawyer to represent him or her in a dispute.

“But sometimes there are people out there who say, ‘I don’t know that I necessarily need a lawyer. I just need some guidance to steer me in the right direction,’” says Su, a partner in the Washington, D.C., office of Bradley Arant Boult Cummings.

The limited-scope representation is a selling point for many volunteers, Su says. ABA Free Legal Answers also provides some flexibility, allowing attorneys to filter questions by subject matter and to decide when to respond.

When Su started with ABA Free Legal Answers, he answered nearly 150 questions in a year. While he hasn’t been able to take that many questions since then because of other duties, he still finds time to volunteer.

“On a per-question basis, most questions can be answered in 30 minutes or less,” Su says. “It’s not hard to find some free time to do 15 or 20 or 30 questions in a given year.”

ABA Free Legal Answers has grown and evolved

Lewis continues to contribute to ABA Free Legal Answers.

A past chair and now special advisor to the Standing Committee on Pro Bono and Public Service, he volunteers for the platform. He is also an alumnus of the University of Tennessee College of Law and works with students to answer questions during its pro bono clinics.

Lewis makes a point of sending questions to students ahead of time so they can prepare their responses.

“You have more of an opportunity to give a good answer than you would in a library on a Saturday morning,” he says. “It also drives home the lesson for students that pro bono is important and helps familiarize them with Free Legal Answers before they even graduate.”

In 2021, then-ABA President Patricia Lee Refo encouraged law firms to get their summer associates involved in ABA Free Legal Answers. In this year’s ABA Free Legal Answers Summer Associate Challenge, at least 43 summer associates and 26 attorneys from nine states answered more than 150 questions.

At least 21 ABA Free Legal Answers service projects were completed in October as part of the National Celebration of Pro Bono. Also that month, the ABA Section of Litigation hosted a service project at its Fall Leadership Meeting, where at least 26 attorneys answered nearly 60 questions from residents of 17 states.

ABA Free Legal Answers is collaborating with the Legal Design Lab at Stanford University and Baylor Law School to improve the experiences of people seeking legal assistance through the platform. As part of a current project, they are working to identify and provide responses to frequently asked questions in the highest need areas.

Users in states that have experienced natural disasters, such as Hurricane Ian, also can access relevant responses and resources.

“We’re not going to solve the justice gap with one website,” Lewis says. “But in my view, it’s become something that any state would want to have in their toolbox.”

Attorney who immigrated to the US now provides pro bono help to immigrants

Dahlia French has prioritized pro bono throughout her career.

She helps immigrants who qualify for Temporary Protected Status and foreign nationals who need assistance with their taxes. She mentors other immigration attorneys through the American Immigration Lawyers Association. And in the past year, she became one of the most active volunteers on ABA Federal Free Legal Answers, an online platform that launched in 2021 and allows indigent immigrants and asylum-seekers to ask attorneys questions about their cases.

“I remember connecting and opening up the emails for the first time—and there had to be about 25 of them,” says French, who manages her own practice in Lubbock, Texas. “I thought, ‘Oh my gosh, this is horrible that there are so many people needing help and not realizing that there are other resources out there.’”

French has answered more than 100 questions on the Federal FLA website, according to the Commission on Immigration, which highlighted French for her work in late March. While questions vary, she says they largely focus on family issues, such as how a U.S. citizen can get a green card for her spouse or support a nephew who entered the country as an unaccompanied minor. Others are about removal proceedings or eligibility requirements for TPS.

In many cases, French adds, people simply need help finding free or low-cost services in their area. It takes her less than 10 minutes to send them that information.

“I like that I can say to people, ‘These are the resources where you’ve got licensed immigration attorneys or [Board of Immigration Appeals] accredited organizations that are here to give you help. Do not use someone who is not licensed. Do not use someone on a website or in your neighborhood,’ ” French says. “When I submit my replies, I always feel good because I feel like I’ve at least got them in the right direction.”

French—who was born in England, lived in Canada and came to the United States for law school—became interested in immigration law after applying for permanent residence in the U.S. in the early 1990s. For nearly 16 years, she worked in higher education while also maintaining her private practice. She left her last position at Texas Tech University Health Sciences Center in April 2021, and now focuses solely on complex immigration filings for academics, researchers and physicians; nonresident alien taxation; and federal health law.

As she sought more balance in her life, French says she was drawn to Federal FLA because it allows her to continue her pro bono work in a more manageable way. She encourages other attorneys who want to volunteer but don’t think they have time to also get involved.

“For me, it’s kind of my wind-down thing, and almost every day I check in,” French says. “If you are an attorney who didn’t want to do a lot, only had one or two hours to devote to pro bono, absolutely get on the site.

“If you are an attorney who is fluent in Spanish, absolutely get on the site and just answer the questions that are in the Spanish language. That would be a huge help because those are the questions I have to completely avoid.”

In addition to immigration questions, volunteer attorneys can answer veterans’ questions on Federal FLA. The ABA also continues to operate its original Free Legal Answers program, which allows income-eligible users in 38 states and the U.S. Virgin Islands to ask volunteer attorneys questions about family law, housing and other civil legal issues.

ABA Free Legal Answers surpasses 200,000 questions, 10,000 volunteer attorneys

CHICAGO, Feb. 8, 2022 —The American Bar Association web program ABA Free Legal Answers, which gives income-eligible users the ability to pose civil legal questions to volunteer attorneys, surpassed 200,000 total questions in January, doubling the number of its inquiries in less than two years.

Launched in 2016, 45 states and more than 10,000 attorneys nationally have committed to participate in ABA Free Legal Answers, which serves as a virtual legal advice clinic. The nationwide program, which has been widely praised as a no-cost way for eligible participants to obtain basic civil legal guidance, hit 100,000 questions in March 2020. Through Jan. 31, the program has recorded 200,592 inquiries.

“For those who cannot afford an attorney and have nowhere else to turn, Free Legal Answers serves as a critical resource,” ABA President Reginald Turner said. “Sadly, hitting the milestone of 200,000 questions underscores the need for expanding free and affordable civil legal services. We are proud of the more than 10,000 volunteer lawyers nationwide who are helping to meet these important legal needs and urge other attorneys to step up and offer assistance as well.”

Geared to expand legal services for low-income communities, users of the service must meet income eligibility guidelines applicable to each state. While improving access to legal services, ABA Free Legal Answers also expands pro bono opportunities for attorneys in a convenient way to match their schedules. Legal guidance is limited to noncriminal matters and takes place entirely online.

The rapid increase in the number of questions during the past two years tracks the U.S. emergence of COVID-19 in March 2020. In the first few months of the pandemic, ABA Free Legal Answers responded by temporarily increasing its question limit per client while many states raised their income/asset cap. The higher caps remain in a dozen states today.

Throughout the near six-year program, the types and volumes of questions have remained relatively steady, with roughly four out of 10 questions or 40% relating to family and children-related legal matters; 15% stemming from housing and homelessness; and 10% involving consumer/finance.

Residents of Texas, Florida, Indiana, Illinois and Tennessee have generated the most questions, with the highest number of participating attorneys coming from Florida, Tennessee, Illinois, Texas and North Carolina. Nationwide, more than 43,400 hours of pro bono legal service were submitted with 10,288 volunteer attorneys registered to participate. And through January, 11,752 veterans and 15,365 seniors have submitted questions.

ABA Free Legal Answers announces 2021 leaders lending pro bono support

CHICAGO, March 15, 2022 —The American Bar Association web program ABA Free Legal Answers, which gives income-eligible users the ability to pose civil legal questions to volunteer attorneys, has released a nationwide list of lawyers, law firms, corporate law departments, law schools and other legal organizations who last year handled the most online questions.

In less than six years, 45 states and more than 10,000 attorneys nationally have committed to participating in ABA Free Legal Answers (FLA), which serves as a virtual legal advice clinic. Of those, more than 140 attorneys in 2021 — the most ever — handled at least 50 civil legal questions each and are recognized as 2021 Pro Bono Leaders.

“For those who cannot afford an attorney and have nowhere else to turn, ABA Free Legal Answers serves as a critical resource,” ABA President Reginald Turner said. “We are proud of the more than 10,000 volunteer lawyers nationwide who are helping to meet these important legal needs, and particularly pleased about the efforts of our FLA Pro Bono Leaders. We urge other attorneys to step up and assist as well.”

Participate in Meaningful Pro Bono from Your Home: ABA Free Legal Answers

ABA Free Legal Answers is a virtual legal advice clinic that allows income eligible individuals to post civil legal questions online seeking advice from volunteer attorneys. Licensed participating attorney volunteers log into the website, select questions they would like to answer, and provide legal information and advice. Users receive an email when their question receives a response.

Access to Justice

ABA Free Legal Answers is a valuable resource for individuals who may otherwise be ineligible for legal services due to conflicts, income eligibility, or citizenship status. ABA Free Legal Answers has been beneficial for those unable to access traditional, in-person services due to geographic or other limitations. This platform has become an even more needed resource during the pandemic as traditional walk-in clinics or in-person services are limited.

Convenient Pro Bono

Free Legal Answers provides an easy and convenient way for attorneys to do pro bono on a short-term, limited basis. Attorneys can spend as much time as they want on the site and answer as many, or as few, questions as they choose. The ABA provides malpractice insurance for volunteers. Local administrators offer training and guidance to attorneys registered on their state’s site. Volunteers can indicate their preferred areas of law and will receive an email notifying them when a user submits a question in that category. The format is beneficial for newer attorneys who can gain valuable experience by researching the questions and drafting responses. A Florida Free Legal Answers volunteer stated, “I find it rewarding that I can take 30 minutes and possibly help someone who is really stuck. I think it should be required of all attorneys as part of our pro bono services. You don’t even have to leave your desk to help someone in need.”

COVID-19

As the pandemic-related legal issues continue to mount, ABA Free Legal Answers serves as a valuable pro bono resource for those in need of legal assistance while reducing the burden on legal providers facing increased need. Clients can easily access legal advice without meeting face-to-face with an attorney. In response to the pandemic, ABA Free Legal Answers temporarily increased its question limit for clients, and many states increased the asset and income caps for the site. Legal questions in areas commonly associated with the pandemic showed a notable increase over the last year, primarily in housing and employment-related questions.

Expanded Practice Areas

In 2021, the ABA expanded Free Legal Answers to the areas of veterans and immigration questions. Qualified attorneys across the country can volunteer at abafederal. freelegalanswers.org to answer questions for immigrants and asylum seekers on topics such as deportation, green cards, DACA, and naturalizations. Volunteers can now assist veterans, including survivors and dependents, by answering questions about VA benefits, discharge upgrades, and other related areas. This expansion is especially significant during the pandemic when in-person services are limited and personal health concerns persist. The need for and value of this model to address basic legal questions is demonstrated in the growth of ABA Free Legal Answers since its 2016 launch. As of the date of this writing, 39 jurisdictions are live with a Free Legal Answers site, with another 6 committed to participate. Users have submitted more than 150,000 civil legal questions to date, and as of February 2021, more than 9,000 volunteer attorneys are registered to answer questions on Free Legal Answers. The most common categories of questions asked on Free Legal Answers are family law, housing and homelessness, consumer rights, and bankruptcy. Signing up for ABA Free Legal Answers is easy. Law Students Get Pro Bono Experience With ABA Free Legal Answers

ABA Free Legal Answers (ABA FLA) is the first and only national online legal clinic through which income-eligible clients can post civil legal questions to be answered by pro bono attorneys from their jurisdiction. Since its launch in 2016, and increasingly during the pandemic crisis, ABA FLA serves as a valuable and convenient pro bono resource for attorneys, clients and law students as it is entirely virtual and can address many legal questions, both typical and pandemic based, including family, housing, consumer, and employment matters.

In February 2021, ABAFreeLegalAnswers.org (ABA FLA) surpassed 150,000 questions submitted and 9,000 volunteer attorneys registered since launch. To date, 39 jurisdictions, including a federal site addressing immigration and federal veteran matters, are live for client access and an additional six jurisdictions have committed to participate.

As a pro bono opportunity providing legal research and writing experience, ABA FLA has been a popular medium for law schools across the country. For instance, since 2018, the University of Nebraska College of Law has received the ABA Free Legal Answers Pro Bono Leader recognition for its active participation on the site. Under the supervision of clinical associate professor Ryan Sullivan, Nebraska College of Law students assisted in answering 127 total questions in 2020.

“Last year brought challenges that no one expected,” said Professor Sullivan. “Answering questions through the Free Legal Answers Program was one way for the clinic and our students to support our community.” Northwestern Pritzker School of Law utilizes a similar model in which the school’s legal clinic professor works with students on strategies and tips for answering questions, pairs them in Zoom breakout rooms, and then reviews their drafts with them before posting on the answer on her account.

Since July 2020, DePaul College of Law has been matching students with attorney volunteers to answer questions on the site, answering over 200 questions so far. “Since the onset of the COVID-19 pandemic, I have been seeking ways for our law students to help fill the justice gap through remote service opportunities that could be done safely from home,” said Lauren Worsek, Director of the Pro Bono and Community Service Initiative and Assistant Director of Public Interest Law at DePaul University College of Law.

“[ABA FLA is] a great way for our DePaul community to provide remote pro bono legal services on an ongoing basis. Our volunteers love that the program is flexible, provides the opportunity to work on a variety of legal issues, and allows them to help people throughout the state who otherwise would not have access to an attorney,” said Ms. Worsek.

Similar models can be found at University of Arkansas School of Law, University of South Carolina School of Law, University of Tennessee College of Law and at Marquette University Law School in which law students work on answers to questions and collaborate with professors and local attorneys until well-drafted responses are ready to submit back to the client through the supervising attorney’s account.

“Unlike anything we’re doing in the classroom, this is something that gives students exposure to issues they would not see otherwise,” said Kristen Anderson a former University of Tennessee law student who helped coordinate UT’s pro bono efforts, in a 2019 UT online article.

“This keeps me sane,” Ms. Anderson said. “These issues are very centered and very real. In class, we’re dealing with big picture, federal issues. But this – this is real life. This is what we’ll face in practice every day, and it’s teaching us what to do to get answers for our clients,” said Ms. Anderson.

Suffolk University Law has developed a different model, utilizing ABA FLA with law students in the context of legal practice skills courses. At Suffolk, students were split into small groups to research questions posted on the site and drafted responses for their professors outlining their discoveries.

Law school researchers and their students are also using the data collected from submitted questions as a learning experience, including the Legal Design Lab at Stanford Law School. The Legal Design Lab produced a Digital Legal Needs Analysis based on ABA FLA submitted questions, identifying the types and seasonality of legal problems for advocates to better predict access-to-justice challenges before they occur.

In addition, Stanford is partnering with Baylor Law School to research housing-related questions submitted on ABA FLA to identify which specific problem scenarios are occurring most frequently among the platforms’ users, and also to propose content and automated replies that may be provided to these users for the given scenarios.

“Working on this project allows our students to examine the practical realities of the access to justice gap,” said Stephen Rispoli, Assistant Dean of Student Affairs and Pro Bono Programs at Baylor Law School. “Although we discuss the issues in law school, by working on this project students get to learn about the real-life hardships that many Americans face and how a lawyer could help them. At the same time, they get to work on a solution by providing assistance with issues that many Americans face. This work, and other projects like it, are critical to closing the justice gap,” said Dean Rispoli.

2021 Summer Associates Assist with Answering Questions on ABA Free Legal Answers

This year, in response to the increasing need for pro bono legal services and the desire to instill a commitment to pro bono early on in an individual’s legal career, ABA President Patricia Lee Refo called upon law firms to involve their summer associates in answering civil legal questions from income-eligible individuals in their state through ABA Free Legal Answers (ABA FLA).

After personal experience in an ABA FLA virtual clinic as a volunteer attorney last spring, President Refo seized upon an opportunity to urge firms to pair summer associates with existing volunteer attorneys to answer as many questions as possible.

“ABA Free Legal Answers provides associates with a taste of pro bono service that will endure throughout their career. In turn, the law firm attorneys who collaborate with these young lawyers will likewise find the process rewarding,” said President Refo.
